Nevada Bans Pre-Employment Drug Testing for Marijuana

If you smoke marijuana recreationally in the State of Nevada, which you legally can do, you won’t have to worry about a pre-employment drug test for marijuana starting on January 1, 2020.  According to the Nat Law Review, this bill, Assembly Bill No. 132, was put into action and signed by the governor on June 5.  Nevada becomes the first State to do this, despite New York City doing this on a City level previously.

Nevada Makes Pre-Employment Weed Tests Illegal

What the law essentially does is state that it’s unlawful for any employer to refuse to hire someone because of a drug test result that tests positive for marijuana.  The test can be via urine, hair, blood, saliva, or even detect another controlled substance other than marijuana.  There are some restrictions, like if you are apply for a position as a firefighter, emergency medical technician, or anything operating a motor vehicle that would make you submit a drug test, or another position that could affect safety and well being of others.

Further, the law goes on to state that if an employer does need  a drug test within the first 30 days on the job, the employee has a legal right to provide and additional drug test at their own expense in order to refute the results of the previous test.  The employer is obligated to give consideration to the result of this drug test.

If the law conflicts with any employment contract or other collective bargaining agreement, or if it’s not within federal law guidelines, it simply doesn’t apply.  In short, there are some restrictions here and rightfully so.

Anyone in Nevada looking to seek out a new job prior to January 1, 2020, should read and review their drug testing policies (pre-employment) and get an understanding of it.  Additionally, outside of removing weed from the testing panel, it’s important to know the job position and what it may entail to see about any exemptions.
